The State Administration for Market Regulation, National Health Commission, National Administration of Traditional Chinese Medicine, National Medical Products Administration, and Supreme People’s Court, among a total of 11 bureaus, have released the “Guidelines on Further Strengthening the Supervision of the Medical Aesthetic Industry.” These guidelines are designed to bring clarity and order to the medical aesthetic services sector in China.
Clarification of Medical Aesthetic Services as Medical Activities
The guidelines stipulate that medical aesthetic services are, in essence, medical activities and must adhere to the legal and regulatory frameworks related to health industry access. This includes compliance with laws and regulations that govern the medical profession, ensuring that medical aesthetic services are conducted safely and effectively.
Building an Efficient Regulatory System for the Industry
Emphasis is placed on constructing an efficient and interconnected industry regulatory system within the existing legal and regulatory framework. This system will operate across multiple dimensions, including registration management, qualification review, sharing of “certificates” and “photos” information, notification and consultation, joint spot checks and inspections, and collaborative supervision, with an execution linkage to enforce compliance.
Provisions to Promote Market Integrity and Consumer Protection
The document also fully considers the laws and characteristics of the medical aesthetic industry, providing provisions in various aspects. These include promoting the optimization of industry access conditions, improving market entity registration management services, and strengthening information disclosure and credit constraints. The aim is to maintain the order of the medical aesthetic market, effectively protect the physical health and life safety of the people, and promote the high-quality development of the medical aesthetic industry.-Fineline Info & Tech
